Sold a probate property for less than its value for Inheritance Tax?

The estate may qualify if
- Inheritance Tax was paid
- The executors sold it, within 4 years of the death
- It sold for less than its value for Inheritance Tax
It won't qualify if
- No Inheritance Tax was paid. Many estates pay none: a widowed parent can leave up to £1m tax-free
- A beneficiary sold it after it passed to them

Questions
Is this real?
Yes. It's set out in section 191 of the Inheritance Tax Act 1984, and claimed on HMRC form IHT38. Links to both are above.
What does it cost?
Nothing unless HMRC pays a refund. If it does, our fee is 25% of the refund plus VAT. The calculator on this page shows the figure after our fee; the refund figures in our letter are before it.
How did you find me?
From public records: the deceased estates notice in The Gazette, which names the executors, and HM Land Registry, which records the sale price. We write by post only.
Why don't you know what the property was valued at?
The value given for Inheritance Tax is private, between the executors and HMRC. That's why our letter shows what the refund would be at a range of values: you can match it to the real figure.
What if no Inheritance Tax was paid?
Then there's nothing to reclaim, and we're sorry to have troubled you. Many estates pay none, for example when everything goes to a husband, wife or civil partner, or a widowed parent leaves the home to their children. Not sure? HMRC's free Inheritance Tax checker will tell you whether tax was likely due.
Can I claim myself?
Yes, free, on form IHT38. We're here if you'd rather someone else did the work.
I'd rather not hear from you
Of course. Contact us, or call or email with your reference, and we won't write again.
