Terms and conditions
In short
No win, no fee. You pay nothing upfront, and nothing at all if HMRC makes no refund.
If HMRC refunds tax because of our claim, our fee is 25% of the refund, plus VAT. HMRC pays the refund into our client account; we deduct our fee and pay the rest to the estate within 5 working days, with a statement.
Any interest HMRC pays belongs to the estate. You can cancel within 14 days, free. You can always claim yourself, free, on HMRC form IHT38.
1. About us
InheritanceTaxRefund.co.uk is a trading name of Richmond Capital Holdings Ltd, registered in England and Wales (company no. 17137348), 18a Milner Street, Halsey House, London, SW3 2PU ("we", "us"). Email hello@inheritancetaxrefund.co.uk. We are an independent firm. We are not HMRC, and we are not connected with HMRC, The Gazette or HM Land Registry.
2. These terms
These terms apply to this website and to our service. When you instruct us, you also sign our Letter of Authority and Fee Agreement, which sets out the same terms for your claim. If there is any difference, the signed agreement applies. "You" means the personal representatives (executors or administrators) of the estate who instruct us.
3. Using this website
- The refund calculator gives an estimate only, based on the figures you enter. It is not advice, and it is not a promise that a claim will succeed or of the amount HMRC will pay.
- The actual refund depends on the value agreed for Inheritance Tax, whether tax was paid, who sold the property, any other land or buildings sold within four years of the death, and HMRC's decision.
- We try to keep the site accurate and available, but cannot guarantee it is free of errors or always online.
4. What we do
- Check whether the estate is likely to qualify for relief on the sale of land at a loss (section 191 Inheritance Tax Act 1984).
- Prepare HMRC form IHT38 and any supporting schedules for every personal representative to check and sign. HMRC only accepts the claim signed by the personal representatives themselves.
- Submit the claim, deal with HMRC's questions until the claim is decided, and keep you updated at each stage.
- Receive and pass on the refund as set out in section 6.
You agree to give us accurate information, including the value of the property agreed for Inheritance Tax, and to tell us about any other land or buildings the estate sold within four years of the death, because those sales can increase or reduce the claim.
5. Our fee
- No win, no fee. There are no upfront charges, no expenses and no charge for the initial check.
- If HMRC repays Inheritance Tax as a result of a claim we prepare or submit, our fee is 25% of the tax repaid, plus VAT at the rate in force when we invoice.
- Our fee is worked out on the tax repaid only. Any repayment interest HMRC pays belongs to the estate, and we take no fee on it.
- If HMRC repays nothing, you owe us nothing.
| Example: refund from HMRC | £20,000 |
| Our fee (25%) | £5,000 |
| VAT on our fee (20%) | £1,000 |
| Paid to the estate (plus any interest from HMRC) | £14,000 |
6. How the refund is paid
- On the IHT38 and in a separate authority, you direct HMRC to pay the repayment into our segregated client account. HMRC has confirmed it accepts repayment to an agent's account with the personal representatives' written authority.
- We hold the money on trust for the estate. It is kept separate from our own money and used for no other purpose.
- Within 5 working days of receiving it, we deduct our fee and VAT and pay the balance, including any interest, to the estate's UK bank account that you gave us when you instructed us. We send you a written statement showing the refund, our fee, VAT and the amount paid.
- We only pay the estate's own account, or the personal representatives' account. To protect you from fraud, any change to those bank details must be confirmed by every personal representative in writing and by a phone call to a number we already hold.
If you ask for the refund to be paid to the estate instead. If you prefer HMRC to pay the estate directly, we agree this in a short written variation. In that case:
- you tell us within 5 working days of the estate receiving the repayment (HMRC's decision letter also comes to us as the named contact);
- we send our invoice, and you pay it within 14 days, from the repayment and before it is distributed to beneficiaries;
- every personal representative who signs is responsible for paying our fee, together and individually;
- if an invoice is paid late, we may charge interest at 4% a year above the Bank of England base rate from the due date until payment, and our reasonable costs of recovering the debt.
7. If HMRC changes the refund later
HMRC may allow relief provisionally and finalise it later, or adjust a refund after it is paid. If the final repayment is lower than the amount our fee was based on, we will refund the difference in our fee and VAT. If it is higher, our fee is 25% (plus VAT) of the higher amount.
8. Your right to cancel
- You can cancel within 14 days of signing our agreement, without giving a reason and at no cost, by emailing or writing to us with your reference.
- If you ask us to start work within the 14 days and then cancel, nothing is payable unless HMRC has already made a repayment as a result of our work.
- After 14 days, you can end your instruction at any time in writing. If HMRC later makes a repayment on a claim we prepared or submitted before you ended it, our fee is payable on that repayment.
9. Things we are not responsible for
- HMRC's decisions and timescales. HMRC usually decides within about 8 weeks, but this is not guaranteed.
- Information you give us that turns out to be wrong or incomplete.
We prepare claims with reasonable care and skill. Our total liability to you in connection with a claim is limited to the fee we receive for it, except where the law does not allow liability to be limited (for example for death or personal injury caused by negligence, or fraud). Nothing in these terms affects your statutory rights.
10. Your information
We use your information only to check and pursue the claim and keep it as described in our privacy policy. We carry out identity and anti-money laundering checks on personal representatives before acting, as the law requires.
11. Complaints
If you're unhappy, please contact us or email hello@inheritancetaxrefund.co.uk. We'll acknowledge your complaint within 3 working days and give you a full reply within 14 days.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
